中华人民共和国国家安全法实施细则 Implementing Rules of the State Security Law of the People’s Republic of China (1994年5月10日国务院令第157号发布) 1994-06-04 Adopted by the 19th Executive Meeting of the State Council 第一章总则 Chapter 1 General Principles 第一条根据《中华人民共和国国家安全法》(以下简称《国家安全法》)，制定本实施细则。 Article 1 These Rules are formulated according to the State Security Law of the People’s Republic of China (hereinafter referred to as the “State Security Law”). 第二条国家安全机关负责本细则的实施。 Article 2 The State security organs shall be responsible for carrying out these Rules. 公安机关依照《国家安全法》第二条第二款的规定，执行国家安全工作任务时，适用本细则有关规定。 When the public security organs perform tasks for State security according to the provisions of paragraph 2, Article 2 stipulated in the State Security Law, the relevant provisions of these Rules shall apply. 第三条《国家安全法》所称的"境外机构、组织"包括境外机构、组织在中华人民共和国境内设立的分支(代表)机构和分支组织； Article 3 “Institutions or organizations beyond the territory of the People’s Republic of China” mentioned in the State Security Law shall include the branch or representative institutions and branch organizations set up within the territory of the People’s Republic of China by the institutions or organizations beyond the territory of the People’s Republic of China; "境外个人"包括居住在中华人民共和国境内不具有中华人民共和国国籍的人。 “Individuals beyond the territory of the People’s Republic of China” shall include those persons who inhabit within the territory of the People’s Republic of China but haven’t the nationality of the People’s Republic of China. 第四条《国家安全法》所称的"间谍组织代理人"，是指受间谍组织或者其成员的指使、委托、资助，进行或者授意、指使他人进行危害中华人民共和国国家安全活动的人。 Article 4 An agent of an espionage organization” mentioned in the State Security Law refers to a person who is instigated, entrusted or financially supported by an espionage organization or its member to conduct, or incite and instigate other persons to conduct, activities endangering the State security of the People’s Republic of China. 间谍组织和间谍组织代理人由中华人民共和国国家安全部(以下简称国家安全部)确认。 The identification of espionage organizations and their agents shall be conducted by the Ministry of State Security of the People’s Republic of China (hereinafter referred to as “the Ministry of State Security”). 第五条《国家安全法》所称的"敌对组织"，是指敌视中华人民共和国人民民主专政的政权和社会主义制度，危害国家安全的组织。 Article 5 A “hostile organization” mentioned in the State Security Law refers to the organization, which is hostile to the State power of the people’s democratic dictatorship and the socialist system of the People’s Republic of China and endangers the State security. 敌对组织由国家安全部或公安部确认。 The Ministry of State Security or the Ministry of Public Security shall conduct the identification of hostile organizations. 第六条《国家安全法》第四条所称"资助"实施危害国家安全的行为，是指境外机构、组织、个人的下列行为： Article 6 “Financial support” for activities endangering State security mentioned in Article 4 of the State Security Law refers to any of the following activities conducted by institutions, organizations, or individuals beyond the territory: (一)向有危害国家安全行为的境内组织、个人提供经费、场所和物资的； (1) Offering funds, locations or materials to organizations or individuals within the territory that are engaged in activities endangering State security; or (二)向境内组织、个人提供用于进行危害国家安全活动的经费、场所和物资的。 (2) Offering funds, locations or materials to be used for activities endangering State security to organizations or individuals within the territory. 第七条《国家安全法》第四条所称"勾结"实施危害国家安全的行为，是指境内组织、个人的下列行为： Article 7 “In collusion” in conducting activities endangering State security mentioned in Article 4 stipulated in the State Security Law refers to any of the following activities conducted by organizations or individuals within the territory: (一)与境外机构、组织、个人共同策划或者进行危害国家安全活动的； (1) Plotting or committing activities endangering State security in association with institutions, organizations or individuals beyond the territory; (二)接受境外机构、组织、个人的资助或者指使，进行危害国家安全活动的； (2) Accepting financial support or instigation from institutions, organizations or individuals beyond the territory to conduct activities endangering State security; or (三)与境外机构、组织、个人建立联系，取得支持、帮助，进行危害国家安全活动。 (3) Establishing relations with and acquiring support and assistance from institutions, organizations or individuals beyond the territory to conduct activities endangering State security. 第八条下列行为属于《国家安全法》第四条所称"危害国家安全的其他破坏活动"： Article 8 The following acts shall be included in the scope of “any other act of sabotage endangering State security” mentioned in Article 4 stipulated in the State Security Law: (一)组织、策划或者实施危害国家安全的恐怖活动的； (1) Organizing, plotting or conducting terrorism activities endangering State security; (二)捏造、歪曲事实，发表、散布文字或者言论，或者制作、传播音像制品，危害国家安全的； (2) Fabricating or distorting facts, or publishing or spreading writings or opinions, or manufacturing or distributing audio and video products in order to endanger State security; (三)利用设立社会团体或者企业事业组织，进行危害国家安全活动的； (3) Establishing social organizations, enterprises or institutional organizations in order to engage in activities endangering the State security; (四)利用宗教进行危害国家安全活动的； (4) Making use of religion to engage in activities endangering the State security; (五)制造民族纠纷，煽动民族分裂，危害国家安全的； (5) Fomenting disputes among ethnic groups or inciting national separatism in order to endanger State security; and (六)境外个人违反有关规定，不听劝阻，擅自会见境内有危害国家安全行为或者有危害国家安全行为重大嫌疑的人员的。 (6) Any person beyond the territory who, in violation of the relevant provisions and without paying heed to dissuasion, meets with any person with willful intend within the territory who have conducted activities endangering State security or being strongly suspected of doing so. 第二章国家安全机关在国家安全工作中的职权 Chapter 2 Authorities of the State Security Organs in the Work of State Security 第九条境外个人被认为入境后可能进行危害中华人民共和国国家安全活动的，国家安全部可以决定其在一定时期内不得入境。 Article 9 As for the person beyond the territory who is regarded as likely to engage in activities endangering State security of the People’s Republic of China after entering the territory, the Ministry of State Security may decide not to allow him to enter the territory for a specified period. 第十条对背叛祖国、危害国家安全的犯罪分子，根据《国家安全法》第六条的规定，国家安全机关可以通缉、追捕。 Article 10 As for the criminals having betrayed the motherland and endangering State security, the State security organs may, according to the provisions of Article 6 stipulated in the State Security Law, list as wanted and pursue and arrest them. 第十一条国家安全机关工作人员依法执行国家安全工作任务时，对发现身份不明，有危害国家安全行为的嫌疑人员，可以检查其随带物品。 Article 11 When carrying out a task for State security pursuant to law. Functionaries of State security organs may inspect the personal articles carried by any unidentified person who is suspected of having conducted activities endangering State security. 第十二条国家安全机关执行国家安全工作紧急任务的车辆，可以配置特别通行标志和警灯、警报器。 Article 12 The vehicles of the State security organs used for performing an urgent task for State security may be equipped with a special pass sign as well as a warning lamp and an alarm. 第十三条依据《国家安全法》第十一条的规定，国家安全机关对查验中发现的不符合维护国家安全要求的电子通信工具、器材等设备、设施，可以责令有关组织和个人进行必要的技术处理； Article 13 Pursuant to the provisions of Article 11 stipulated in the State Security Law, the State security organs may, upon finding any electronic communication instruments or appliances and other similar equipments or installations which are not in compliance to the requirements for safeguarding State security during the inspection, order the relevant organization or individual to conduct necessary technical treatment in respect of the relevant equipment or installation; 拒绝或者没有能力进行技术处理的，可以予以封存、扣押，依照有关法律、行政法规的规定处理。 in case the organization or individual refuses or is unable to carry out such treatment, the State security organs may seal them up for safekeeping or withhold them, and deal with them according to the provisions of the relevant laws and administrative regulations. 第十四条国家安全机关工作人员依法执行国家安全工作任务的行为，不受其他组织和个人的非法干涉。 Article 14 The activities of the functionaries of State security organs in performing a task for State security pursuant to law shall not be subject to any unlawfully interference by any other organization or individual. 国家安全机关工作人员依法执行国家安全工作任务时，应当出示国家安全部侦察证或者其他相应证件。 Any functionary of a State security organ shall, when performing a task for State security pursuant to law, bring forth a reconnaissance certificate issued by the Ministry of State Security or other appropriate certificate. 国家安全机关及其工作人员在国家安全工作中，应当严格依法办事，不得超越职权、滥用职权，不得侵犯组织和个人的合法权益。 The State security organs and their functionaries shall, in their work for State security, act strictly pursuant to law, and may not exceed or abuse their authorities or infringe upon the lawful rights and interests of any organization or individual. 第三章公民和组织维护国家安全的义务和权利 Chapter 3 Duties and Rights of Citizens and Organizations in Safeguarding State Security 第十五条机关、团体和其他组织对本单位的人员进行维护国家安全的教育，动员、组织本单位的人员防范、制止危害国家安全行为的工作，应当接受国家安全机关的协调和指导。 Article 15 Educating their personnel in respect of upholding State security, and mobilizing and organizing them to prevent and check activities endangering State security organs, groups and other institutions shall accept coordination and guidance from the State security organs. 第十六条公民发现危害国家安全的行为，向所在组织报告的，所在组织应当及时向国家安全机关或者公安机关报告，不得延误。 Article 16 Any citizen finding an activity endangering State security and reporting it to his or her work unit, the latter shall promptly report it to a State security organ or a public security organ immediately. 第十七条公民和组织支持、协助国家安全工作，有权要求国家安全机关、公安机关采取有效措施，防范、制止侵犯其合法权益的行为。 Article 17 Citizens and organizations providing support and assistance for the State security work shall be entitled to ask the State security organs and public security organs to take effective measures to prevent or check any act from infringing upon their lawful rights and interests. 第十八条下列情形属于《国家安全法》第五条所称的"重大贡献"： Article 18 The following circumstances shall be included in the scope of “significant contribution” mentioned in Article 5 stipulated in the State Security Law: (一)为国家安全机关提供重要线索，发现、破坏严重危害国家安全的犯罪案件的； (1) Providing important clues to the State security organs for discovering and cracking down criminal cases which seriously endanger State security; (二)为国家安全机关提供重要情况，防范、制止严重危害国家安全的行为发生的； (2) Providing important information to the State security organs for preventing or checking the occurrence of activities which seriously endanger State security; (三)密切配合国家安全机关执行国家安全工作任务，表现突出的； (3) Cooperating closely with the State security organs in performing tasks for State security, and making outstanding performance in doing so; (四)为维护国家安全，与危害国家安全的犯罪分子进行斗争，表现突出的； (4) Struggling against the criminals whose activities endanger State security so as to safeguard State security, and making outstanding performance in doing so; or (五)在教育、动员、组织本单位的人员防范、制止危害国家安全行为的工作中，成绩显著的。 (5) Educating, mobilizing and organizing the personnel of one’s unit to prevent or check the occurrence of activities which endanger State security and having outstanding achievements in doing so. 第十九条《国家安全法》第二十条所称"非法持有属于国家秘密的文件、资料和其他物品"是指： Article 19 “Unlawfully in possession of any document, material or other articles pertaining to State secrets” mentioned in Article 20 stipulated in the State Security Law means: (一)不应知悉某项国家秘密的人员携带、存放属于该项国家秘密的文件、资料和其他物品的； (1) A person who is not authorized to know a certain State secret is found to bring with him or her or leave in his or her care any document, material or other articles pertaining to that State secret; or (二)可以知悉某项国家秘密的人员，未经办理手续，私自携带、留存属于该项国家秘密的文件、资料和其他物品的。 (2) A person though authorized to know a certain State secret is found to privately bring with him or her or leave in his or her care any document, material or other articles pertaining to that State secret before going through any necessary formalities. 第二十条《国家安全法》第二十一条所称"专用间谍器材"，是指进行间谍活动特殊需要的下列器材： Article 20 “Specialized espionage equipments or devices” mentioned in Article 21 stipulated in the State Security Law refers to the following equipments or devices specially required for espionage activities: (一)暗藏式窃听、窃照器材； (1) Hidden eavesdropping device or camera; (二)突发式收发报机，一次性密码本、密写工具； (2) Burst transceiver, one shot pad for cipher code, or secret writing devices; (三)用于获取情报的电子监听、截收器材； (3) Electronic surveillance and intercepting devices specially used for acquiring intelligence; and (四)其他专用间谍器材。 (4) Other specialized espionage equipment or devices. 专用间谍器材的确认，由国家安全部负责。 The Ministry of State Security shall conduct the identification of any specialized espionage equipments and devices. 第四章法律责任 Chapter 4 Legal Liability 第二十一条实施危害国家安全行为所使用的工具和其他财物，或者本细则第六条所列的经费、场所和物资，国家安全机关可以予以查封、扣押、冻结； Article 21 The instruments or other items of property used for conducting activities endangering State security, as well as the funds, locations and materials mentioned in Article 6 of these Rules may be sealed up, withheld or frozen by the State security organs.; 所查封、扣押、冻结的财物，根据不同情况，由国家安全机关予以没收或者移送司法机关依法处理。 the aforesaid instruments or other items of property sealed up, withheld or frozen shall, according to different circumstances, be either confiscated by the State security organs or transferred to judicial organs for disposal pursuant to law. 国家安全机关没收的财物，一律上缴国库。 The property confiscated by the State security organs shall, in any case, be turned in to the State Treasury. 因泄露国家秘密所获取的财物，依照《中华人民共和国保守国家秘密法实施办法》第三十四条的规定处理。 The property obtained through divulging State secrets shall be disposed according to the provisions of Article 34 stipulated in the Measures for Implementation of Law concerning Safeguarding State Secrets of the People’s Republic of China. 第二十二条实施危害国家安全的行为，构成犯罪的，依法追究刑事责任； Article 22 Where an act endangering State security constitutes a crime, the offender hall be subject to investigation for criminal responsibility pursuant to law; 不构成犯罪的，由其所在单位或者上级主管部门予以行政处分，国家安全机关也可以予以警告、训诫或者责令具结悔过。 where the offence does not constitute a crime, the offender shall be subject to disciplinary sanctions by his or her work unit or by the superior competent department and he or she may also be given a warning or reprimand or be ordered to write a statement of repentance by the State security organs. 第二十三条下列情形属于《国家安全法》第二十四条所称的"立功表现"： Article 23 The following circumstances shall be included in the scope of “meritorious service” mentioned in Article 24 stipulated in the State Security Law: (一)揭发、检举危害国家安全的其他犯罪分子，情况属实的； (1) Exposing or reporting other criminals who endanger State security, and the exposure and charge is proved true; (二)提供重要线索、证据，使危害国家安全的行为得以发现和制止的； (2) Providing important clues or evidences thereby activities endangering State security are discovered and checked; (三)协助国家安全机关、司法机关捕获其他危害国家安全的犯罪分子的； (3) Providing assistance to the State security organs or judicial organs to capture other criminals who endanger State security; or (四)对协助国家安全机关维护国家安全有重要作用的其他行为。 (4) Other acts of great help to the State security organs in safeguarding State security. "重大立功表现"，是指在前款所列立功表现的范围内对国家安全工作有特别重要作用的。 “Significant meritorious service” refers to a service within the scope specified in the preceding paragraph that is of especially great help to the State security work. 第二十四条有证据证明知道他人有危害国家安全的犯罪行为，或者经国家安全机关明确告知他人有危害国家安全的犯罪行为，在国家安全机关向其调查有关情况、收集有关证据时，拒绝提供的，依照《国家安全法》第二十六条的规定处理。 Article 24 If there is evidence which proves that a person knows other persons’ criminal activities endangering State security, or after he or she has been informed explicitly by the State security organs of other persons’ criminal activities endangering State security, he or she shall be punished according to the provisions of Article 26 stipulated in the State Security Law on condition that he or she refuses to provide the information while a State security organ investigates the relevant circumstances or gathers the relevant evidences from him or her. 第二十五条国家安全机关依法执行国家安全工作任务时，公民和组织依法有义务提供便利条件或者其他协助， Article 25 As for a state security organ carrying out tasks for State security pursuant to law, any citizen and organization shall have the duty, pursuant to law, to provide convenience or other assistance; 拒不提供或者拒不协助，构成故障阻碍国家安全机关依法执行国家安全工作任务的，依照《国家安全法》第二十七条第二款的规定处罚。 as for any person or organization refusing to provide such convenience or other assistance and thereby constituting an offence of preventing the State security organ with willful intend from carrying out tasks for State security pursuant to law, he or she shall be subject to punishment according to the provisions of paragraph 2, Article 27 stipulated in the State Security Law. 第二十六条故意阻碍国家安全机关依法执行国家安全工作任务，造成国家安全机关工作人员人身伤害或者财物损失的，应当依法承担赔偿责任，并由司法机关或者国家安全机关依照《国家安全法》第二十七条第二款的规定予以处罚。 Article 26 In respect of any person who prevents the State security organ with willful intend from carrying out tasks for State security pursuant to law and thereby causes personal injuries or property damage or losses to the functionary of the State security organ, he or she shall be subject to compensation pursuant to law, and shall also be subject to punishment by the judicial organ or the State security organ according to the provisions of paragraph 2, Article 27 stipulated in the State Security Law. 第二十七条国家安全机关工作人员玩忽职守、徇私舞弊、非法拘禁、刑讯逼供，构成犯罪的，依法追究刑事责任。 Article 27 As for any State security functionary neglecting his or her duty, engaging in malpractice for personal interests, exercising unlawful detention or extorting a confession by torture, if the offence constitutes a crime, he shall be subject to investigation for criminal responsibility pursuant to law. 第五章附则 Chapter 5 Supplementary Rules 第二十八条本细则自发布之日起施行。 Article 28 These Rules shall take effect as of the date of promulgation.  更多文章
